COURSE DESCRIPTION

81 Bankruptcy Law and Procedure Units: 3.00
 
Prerequisite: None.
 
Bankruptcy law and procedures as related to the role of a paralegal. Students prepare case files for several bankruptcy proceedings as though processed through the court system. Both debtor’s and creditor’s rights and obligations are covered. 54 hours lecture.

STUDENT LEARNING OUTCOMES
Upon successful completion of the course, students should be able to:

1.   Analyze the difference between the bankruptcy court and trial courts
      in the Federal Court system.

2.   Evaluate various remedies available to debtors and select the
      proper chapter under the Bankruptcy Act in which the debtor should
      file.

3.   Draft bankruptcy petitions under Chapter 7 and 13 of the
      Bankruptcy Act.

4.   Evaluate bases for determining when a creditor may file an
      involuntary petition in bankruptcy court against a debtor.

5.   Draft an involuntary petition and other related legal documents
      against a debtor.

6.   Evaluate and prepare written creditor’s claims on behalf of creditors
      in bankruptcy proceedings.

7.   Draft a complaint for non-discharge ability on behalf of a creditor
      challenging the bankruptcy.

8.   Evaluate the appeal process and time limitations applicable in
      bankruptcy proceedings.

9.   Produce legal documents using subject-related application software.
